Terms of Service

These Terms of Service ("Terms") govern your access to and use of Lubbe Labs' Shopify applications, website, and services. By installing our apps or engaging our services, you agree to these Terms.

1. Use of Our Applications

Our Shopify applications are provided for use by Shopify merchants who have accepted Shopify's own Terms of Service. You agree to:

  • Use the apps only for lawful purposes and in accordance with these Terms.
  • Not attempt to reverse-engineer, decompile, or extract the source code of our applications.
  • Not use the apps in a manner that could damage, disable, or impair our infrastructure or services.

2. Subscriptions and Billing

Where applicable, app subscriptions are billed through Shopify's billing system. Charges are clearly displayed prior to subscription. Cancellation takes effect at the end of the current billing cycle. Refunds are handled in accordance with Shopify's billing policies.

3. Intellectual Property

All intellectual property in our applications, including code, design, and documentation, remains the exclusive property of Lubbe Labs. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

4. Custom Development Services

For bespoke development work, a separate Statement of Work ("SOW") or Service Agreement will govern the engagement, including deliverables, timelines, and payment terms. These Terms apply to the extent not superseded by a signed SOW.

5. Disclaimer of Warranties

Our apps and services are provided "as is" without warranty of any kind, express or implied. We do not warrant that the apps will be uninterrupted, error-free, or fit for any particular purpose.

6. Limitation of Liability

To the maximum extent permitted by law, Lubbe Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our apps or services, even if advised of the possibility of such damages.

Our total aggregate liability shall not exceed the fees paid by you to Lubbe Labs in the twelve months preceding the claim.

7. Indemnification

You agree to indemnify and hold Lubbe Labs harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of our apps in violation of these Terms or any applicable law.

8. Termination

We reserve the right to suspend or terminate your access to our apps if you breach these Terms or engage in conduct harmful to other merchants or our services.

9. Governing Law

These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. Any disputes shall be subject to the jurisdiction of the courts of South Africa.

10. Changes to Terms

We may revise these Terms at any time. Updated Terms will be published with a new "Last updated" date. Continued use of our apps following publication constitutes acceptance of the revised Terms.
